Terms & Conditions

By placing an order with ForestGate Solutions, you confirm that you are in agreement with and bound by the terms and conditions below.

Definitions:

The Client: The company or individual requesting the services of ForestGate Solutions

ForestGate Solutions: The partners or their employees.

The contract between ForestGate Solutions and the client will be on these conditions to the exclusion of all other terms and conditions. Any variations to these conditions shall have no effect unless agreed in writing.

The client agrees to make available all materials required to complete the site as soon as is reasonably possible to ForestGate Solutions. If the client fails to supply the information within 60 days, then the project can be terminated at the sole discretion of ForestGate Solutions and all monies paid may not be refunded.

ForestGate Solutions will conduct a complete functionality test prior to making the site “live” on the internet. Where ‘bugs’, errors or other issues are found after the site is live, ForestGate Solutions will correct these issues within 3 (three) working days, wherever possible.

Domain names will be registered by ForestGate Solutions and also registered to the ForestGate Solutions current address. Although the domain names are registered to ForestGate Solutions, the client is the legal owner of the domain. The client may request, if required, to have details changed or the domain transferred elsewhere. If this is requested, all costs involved in detail changes of domain transfers shall be met by the client.

ForestGate Solutions will not contract to produce a website for any illegal activity. ForestGate Solutions shall expect the client to carry out sufficient research before proceeding with a website. This will include checking that the website / idea / business will operate legally within UK law. ForestGate Solutions will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner.

ForestGate Solutions will provide the client with an expected project completion date (live on the internet). ForestGate Solutions will endeavour to meet any given deadline but does not guarantee and is not bound in any way to complete the project by this date. ForestGate Solutions will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

Any additions to the brief will be carried out at the discretion of ForestGate Solutions and ForestGate Solutions reserves the right to charge an appropriate amount for any correction to these or further additions.

All contracts agreed with ForestGate Solutions expire after 12 months. The client can request the cancellation of the service provided by ForestGate Solutions or agree a contract extension, whereupon the applicable fees apply and will be invoiced accordingly.

Renewals of “hosting” and “domain names” are due on a yearly basis. The date of renewal will be annually from the date the website was ordered by the client. The costs of renewals are the responsibility of the client. ForestGate Solutions can complete the renewal process at the request of the client and will invoice accordingly. The renewals will not be carried out if the client cannot be contacted or the client requests cancellation in writing 30 days before expiration.

The client has 30 days upon expiration of the 12 month contract in which to agree to the contract extension. If this isn’t received, ForestGate Solutions will not be held liable for the loss of the domain name or the inability to renew the registration of the domain name. If a cancelled service is to be reinstated at the client's request, a setup fee will be payable before any such reinstatement and any data lost as a result of the cancellation will not necessarily be resolved.

If a domain name is purchased by the client through a company other than ForestGate Solutions, the client has full responsibility in making sure that the domain name is renewed when due. ForestGate Solutions will not renew the domain name when annual hosting renewal is due if the domain name is purchased through a company other than ForestGate Solutions.

All websites, designed by ForestGate Solutions, require the insertion of a “Designed by ForestGate Solutions” link within the content of the clients’ website.

Payment of Accounts

A deposit of 20% of the total invoice amount is required from a new client before any work is carried out. All deposits received are non refundable.

Deposit payments for website development and design services are excluded from the Distance Selling Regulation due to them being tailored specifically for the Clients’ requirements and due to administration costs associated with initiating a project on behalf of the Client.

ForestGate Solutions will only commence work on design after receipt of the agreed deposit fee. Once the quoted project has been completed, the remaining balance becomes due with immediate effect. Unless otherwise agreed by ForestGate Solutions, the clients’ website will not be made live on their selected domain until the agreed account balance is paid in full.

All invoices are to be paid within 7 days of issue unless by prior arrangement with ForestGate Solutions. Initial payments/deposits are non-refundable. If accounts are not settled or ForestGate Solutions has not been contacted regarding the delay, access to the related website may be denied.

ForestGate Solutions reserves the right to pass on any charges incurred as a result of late or declined payments.
